On July 5, 2017, Central Employee Relations Committee (CERC) members signed a memorandum of agreement (MoA) with the government. It amends the new collective agreement that was ratified by members on June 22.
The MoA allows OPS employees to use two of the three special and compassionate leave days in the collective agreement for unforeseen dependant and elder care reasons.
Please note that the MoA does not add any special and compassionate days: the total entitlement remains at three.
The provision will come into effect on January, 1, 2018, when the new collective agreement comes into effect.
MEMORANDUM OF AGREEMENT BETWEEN
THE CROWN IN RIGHT OF ONTARIO (MANAGEMENT BOARD OF CABINET)
"the Employer" and
ONTARIO PUBLIC SERVICE EMPLOYEES UNION (OPSEU)
IN THE MATTER OF:
Enhancement to Special and Compassionate Leave (Article 49 & 75) – Unforeseen Dependant and Elder Care
WHEREAS the parties are signatories to a tentative extension agreement, signed June 2, 2017, for the Unified Bargaining Unit covering the period of January 1, 2018 to December 31, 2021.
AND WHEREAS the parties ratified the tentative extension agreement on June 22, 2017.
NOW THEREFORE the parties agree to the following amendment, as reflected in the Employer's correspondence of June 14, 2017, to the administration of the special and compassionate leave provisions (Article 49 and 75) for the Unified Bargaining Unit:
- Effective January 1, 2018, all employees represented by OPSEU in the Unified Bargaining Unit shall be entitled to up to two (2) special and compassionate days off per year for unforeseen dependant and elder related care issues.
- These two (2) unforeseen dependant and elder related care days are included in, and do not add to, total special and compassionate leave entitlements under article 49 & 75 (i.e. of up to three (3) paid special and compassionate days per year).
- Leave for unforeseen dependant and elder related care issues will only be granted pursuant to this Memorandum of Agreement where the employee has remaining special and compassionate leave credits available to them under Article 49.1 & 75.1, sufficient to cover the duration of his or her request.
- It is understood that, where possible, employees will be expected to give reasonable notice in respect of any leave of absence for the purposes of unforeseen dependant and elder related care.
