Board says worksite visits to continue

After several hours of discussion, Vice-Chair Christopher J. Albertyn, said that the union worksite representatives are entitled to have access to any worksite where:

  • essential or emergency work is being done;
  • employees in the bargaining unit who are on strike or who are locked out would ordinarily perform their work

This means that we do have access to our workplaces where we have members or where we normally would have members. The employer cannot refuse access.

If you have any difficulty with access please contact the central bargaining team immediately. Vice-Chair Albertyn has remained seized to deal with this issue.

Employer ordered to follow the process

The nurses at the Toronto West Detention Centre have been on a work refusal since the employer decided that they were not going to let the Correctional Officers come to work because the managers were afraid of them.

The nurses say that they have a legitimate work refusal because conditions are unsafe without correctional officers at their posts.

Management (about 40 of them, all working 24 hours a day) have said that they will protect the nurses. They’ve even said that some of the managers have worked their way up the ranks and used to be COs.

Management have not followed up on the nurses’ work refusal. They did not allow the health and safety certified member to do an inspection nor did they contact the Ministry of Labour. Instead they filed an application to the labour board.

The Vice-Chair, Laura Traychuk, adjourned the hearing directing management back to the workplace to follow the process.
