Management reacts to your responses!

Yesterday, management filed a complaint at arbitration claiming that the Union was deliberately obstructing the essential service eligibility process. (For the record, the Union is not obstructing the process at all.)

Management's chief complaints were:

  • Union worksite rep unknown
  • local union's refusal to review lists and in many circumstances when lists were reviewed the union worksite rep refused to agree to the list(s)
  • the Union's refusal to mediate disputes and modify agreements in the absence of the bargaining teams

Management demanded that the union worksite reps be appointed immediately, that the lists be done by today and the draws occur by next Friday, March 1st. This meant the disputes would have to be heard next week while the vote is being conducted.

The Union maintained that all this was premature and no order was necessary.

Arbitrator Kathleen O'Neil ordered and this order is reproduced in its entirety as per the order.

In short, it means:

  • that the Union will provide a list of worksite reps by the end of business on March 1st.
  • that locally, union and management worksite reps will meet to review and revise the lists by noon on March 4th and any disputes that arise from this step will be mediated/arbitrated by the teams on March 4th and 5th.
  • that the draws will then occur locally on March 6th.
  • that any remaining disputes will go to mediation/arbitration with the teams on March 7th and 8th.

This order leaves us free to conduct the vote as we have planned.
