Arbitrator's award is good for news for
Biomedical Technologists, clarifies
language on pregnancy and parental leave
We have just received
the award clarifying the Board's
intention on the placement of Biomedical
Technologists on the Registered
Technologists wage grid and the duration
of the continuation of the percentage in
lieu for part-time employees on
pregnancy and parental leave.
The Board awarded
OPSEU's position on the placement of the
Biomedical Technologists onto the RT
wage grid, saying that "it is a
well-accepted principle that no employee
should lose as a result of moving to a
higher classification, and it was
certainly not our intention, and was
clearly an unintended consequence, that
Biomeds would be detrimentally affected
by moving to the RT Grid". On the
Hospitals' issue of the duration of the
continuation of the percentage in lieu
for Part-Time, the Board found that its
original award was ambiguous. It
clarified that its intent was not to
exceed the CUPE and SEIU norm, which is
for 27 weeks, 17 for pregnancy leave and
10 weeks for parental leave, and that
"the length of time for part-time
employees on pregnancy/parental leave is
to be as set out in the SEIU and CUPE
agreements".
Now that this
Award has been issued, the parties can
conclude the implementation process, and
finalize the new central language. OPSEU
will be working to ensure that this
happens as quickly as possible.

HPD Central
Negotiations Update August 2, 2005
OPSEU and
the Participating Hospitals have been
able to resolve most of the
implementation issues arising from the
Beck Board Award.
The
vacation improvements will be
implemented in the following manner:
• The
vacation schedule improvements for
five weeks’ vacation and six weeks’
vacation shall be determined in
accordance with whatever system is in
place in the individual hospital for
determining vacation entitlement.
•
Notwithstanding the above, for
employees who have not yet attained 30
years of continuous service as of June
28, 2005, the additional five days’
vacation is to be banked on the
employee’s 30th anniversary date and
taken prior to their 35 year
anniversary date. Every employee who
has attained their 30th or 35th
anniversary date as of June 28, 2005,
shall be entitled to have the full
five (5) days vacation banked
effective that date.
• To
clarify for part-time employees,
effective June 28, 2005, supplemental
vacation entitlement (equivalent to
full-time employees’ supplemental
vacation entitlement at thirty (30)
and thirty-five (35) years of service)
shall be the equivalent of an
additional 2 per cent vacation pay
increase for the full 1650 hours, paid
to the employee for that equivalent
year of service. The equivalent hours
for the purpose of determining
entitlement are at 49,500 hours and
57,750 hours of service. Local
practice shall determine the method
that this entitlement is paid.
The
parties were able to agree on the
implementation of two of the
reclassifications, Echocardiographers
and Kinesiologists. The parties have
agreed that employees will be placed on
their new wage grid on the basis of
years of continuous service. So, for
example, an employee who has less than
one year of continuous service will be
placed at the start rate, an employee
with five years of continuous service
will be placed at the fifth step and an
Echocardiographer with eight or more
years of continuous service will be
placed at the top step. The anniversary
date of the employees will not change as
a result of the reclassification.
The
parties have also agreed that the change
in probation period applies only to
employees hired on or after June 28,
2005.
Two
issues were not resolved and were
forwarded to the Beck Board for
resolution. OPSEU brought forward the
wage grid and the Biomedical
Technologist reclassification. The
Participating Hospitals brought forward
the duration of the continuation for the
percentage in lieu for part-time
employees on pregnancy and parental
leave. The hospitals are taking the
position that it should be restricted to
27 weeks, but OPSEU believes that the
Award clearly awarded the Union
position, which was for the duration of
the leave. The Beck Board has not yet
made a decision on these issues. HPD
Central Negotiations Update July 21,
2005
Your team
chair, researcher and negotiator met
yesterday with representatives from the
OHA and the participating hospitals
negotiations team to discuss
implementation of the Beck Award. The
parties were able to finalize the agreed
issues and agree to certain housekeeping
changes. Unfortunately we were unable to
agree on implementation of a number of
the awarded issues, so the parties will
be returning to Arbitrator Beck for
resolution.
Outstanding issues include the
implementation of the reclassifications,
the wage grid, and the continuation of
percentage in lieu for part-time
employees on pregnancy and parental
leave. While agreement in principle was
reached on other matters, this was
conditional on reaching overall
agreement, so there may be additional
issues that are brought to the Board. At
this point we are not certain when these
issues will be determined, but will keep
you informed.
The Beck
Board ruled today that the
reclassifications are effective June 28,
2005, the date of the original award,
and are not retroactive to April 1,
2004. This means that Biomedical
Technologists, Echocardiographers and
Kinesiologists will receive their 3 per
cent and 3 per cent wage increases,
effective April 1, 2004 and April 1,
2005, and move to their new wage grid
effective June 28, 2005.
Bargaining Update: July 5, 2005 The central parties are still working to finalize the Agreed Issues (which includes the language on retroactivity) and these will be posted on the website next week.

New agreements available:
The Central Full-time and Part-time agreements from the last round have been sent out to the Staff Reps and posted on our website.
The Demand Set meeting for the upcoming round was held May 1 and 2.
The new team: The following members were elected to the team: Yves Shank, Local 659; Bob Reid, Local 106; Leslie Sanders, Local 348; Boris Prus, Local 141; Bryan Mitchell, Local 570; Marion Savory, Local 366; Keith Olimb, Local 715. At the Bargaining
Team Training held May 17-20, the team elected Yves Shank as Chair and Bob Reid as Vice-Chair.
Bargaining dates: We have the following bargaining dates: July 13 -14 to negotiate the Memorandum of Conditions document, and the weeks of Aug. 16, Sept. 13 and Oct. 18 for negotiations.
New, stronger process: At our demand set meeting, a consensus emerged that delegates want to see a stronger central process and changes in our bargaining structure to support not just central bargaining, but province-wide bargaining.
The HPD executive will consult on the creation of a provincial demand set process.
In this round one of the priorities will be to bargain improvements that strengthen the central process. This includes bargaining superior provisions into our central language. There will be improved information-sharing and coordination.
Still time to join central: It is not too late for bargaining units to join central. If your unit wants to join but your employer won't, talk with your staff rep about setting up a meeting with your employer to educate them on why it makes sense for them
to join.
