We have just received an award clarifying the intention of the Board on the training period for an employee to be able to displace another employee.
As you may recall, the union's position was that the new language should replace the old language in the collective agreement that stated "without training other than orientation." The OHA position was that the new language should simply be added.
The Supplementary Bendel Award states as follows:
"1) We declare that our intention in ordering the amendment of Article 11.03 and 11.04 was to change the circumstances in which an employee can bump, specifically by allowing the bump even though he or she would need some training before being able to perform all the duties of the position; 2) We order the parties to make
such changes to the language of the collective agreement as are necessary to give effect to our intention."
OPSEU will be discussing the necessary changes to the language with the OHA and we hope that the implementation document will be finalized shortly thereafter. The full supplementary award will be posted on this web site as soon as possible.
