HPD Central  Bargaining Timelines

Supplementary Award by Arbitrator Bendel

We have just received an award clarifying the intention of the Board on the training period for an employee to be able to displace another employee.

As you may recall, the union's position was that the new language should replace the old language in the collective agreement that stated "without training other than orientation." The OHA position was that the new language should simply be added.

The Supplementary Bendel Award states as follows:

"1) We declare that our intention in ordering the amendment of Article 11.03 and 11.04 was to change the circumstances in which an employee can bump, specifically by allowing the bump even though he or she would need some training before being able to perform all the duties of the position; 2) We order the parties to make such changes to the language of the collective agreement as are necessary to give effect to our intention."

OPSEU will be discussing the necessary changes to the language with the OHA and we hope that the implementation document will be finalized shortly thereafter. The full supplementary award will be posted on this web site as soon as possible.

November 5, 2003  Update on Implementation of the HPD Central Award 

With agreement on implementation of most of the substantive issues, there remains one key area where the parties are not in agreement. 

When Mr. Bendel awarded the new language on training in Article 11 – Layoff and Recall, he did not delete the existing language that says that an employee can displace another employee if they can perform the duties “without training other than orientation”. 

It is OPSEU’s position that the new language replaces the old language, because its intent is completely different than the old language.  The OHA says it does not replace it and that the new language simply gets added 

We are taking the issue back to Mr. Bendel for clarification and will hopefully have this resolved soon.

September 25, 2003 Supplementary Central Award for Hospital Professionals

Arbitrator Bendel has issued a supplementary award clarifying four issues. The most important among these is clarifying the effect of eliminating the lowest step on the grid for RT and above:

Bendel wrote: "the intent is to move those who were at the start rate to the new start rate, employees at Step 1 will move to the new Step 1 rate, employees at Step 2 will move to the new Step 2 rate, and so on through the grid, and employees at Step 9 will move to the new Step 8 rate, all effective April 1, 2003."

For those not yet at the maximum rate, this will mean additional pay increases of 3.4 to 6.9 per cent..

Here are the final central wage grids for the OPSEU Hospital Professionals Division. Please note that rates paid at some locals may vary from these central rates as a result of a local agreement.

For example, Perfusionists are paid a top hourly rate of $40.91at the Hamilton Health Sciences Centre and $40.75 at Kingston General Hospital; Echocardiographers at Lakeridge Health Corporation receive a top hourly rate of $32.16 (Registered Technologist rate for Ultrasound, MRI and Respiratory Therapy.); Pathologists' Assistants (Autopsy Master) at Lakeridge Health Corporation receive a top hourly rate of 31.22 (the Registered Technologist rate).

OPSEU and the OHA are still discussing implementation of the issues and we will keep you up to date.

Central Bargaining Update

September 3, 2003  Central bargaining - More details on the Bendel Award

The Bendel Award was released Friday, Aug. 29. While we did not achieve all of the gains that we wanted, this is a major step forward in recognition for our professions. We mobilized, we told our stories to the public, and we presented a brief that was factual, strong, detailed and persuasive. Our efforts paid off in the best central agreement yet.

The full award and the unofficial wage grids are available below. Here are the highlights:

Compounded Wage Increase of 14 per cent over two years for Registered Technologists and those above RT. This means that Registered Technologists are closer to the RN maximum than we have been in more than 13 years. Furthermore, the first five steps of the grid are higher than the corresponding steps of the RN grid.

Compounded Wage Increase of 7 per cent over two years for Technicians. This is better than their counterparts in other hospitals.

An additional 3 per cent to the maximum rate for Physiotherapists, Occupational Therapists, Pharmacists, Perfusionists, Ultrasound Technologists, MRI Technologists and RRCPs effective Apr. 1, 2003.

Technicians have increased vacation entitlement that will now equal the vacation entitlement of the rest of the bargaining unit members.

Members in receipt of a layoff notice will be entitled to receive the same training provided to a new employee in order to exercise their displacement rights.

Increases to shift and weekend premiums ($1.10/hour for evening shifts; $1.35/hour for night shifts and $1.45/hour for weekend shifts).

Improvement in the credit for experience language (one year for every year of experience, with no maximum entry level and current employees will be paid at the step to which they would have been entitled if this provision had been in effect when they were hired).

The right for early retirees to continue in the group benefit plans.

Details about implementation of the award will be provided shortly. In the meantime, negotiations for any outstanding local provisions are ongoing and planning for the next round of bargaining has already begun.

The collective agreements expire Mar. 31, 2004. Watch for information about a pre-bargaining conference that will be held before the end of the year. We have come a long way, but there will be more hard work next round to achieve what we need.

Letter from President Leah Casselman to Minister of Health Tony Clement:
President Casselman wrote to the Minister asking for a meeting regarding central bargaining issues for the Hospital Professionals Division, and on the need for improved funding to hospitals targeted to properly compensate staff.

OPSEU members made a long and colourful march down University Avenue and west on Front Street to the Ontario Hospital Association at noon April 5, in support of the HPD central bargaining team. Members of the division were joined by others from the OPSEU convention including the OPS, CAAT and other sectors of the BPS. The rally was led by OPSEU President Leah Casselman, the division executive.  Click here to view photos

Bargaining began March 25. The team launched bargaining with a press conference to tell the public about our demands for better wages and working conditions, and about shortages in our sector. (See the March 22 Press Release)
