This legislation, although called the Putting Students First
Act, 2012, sets a dangerous precedent for all Ontarians. It is an
unprecedented attack on free collective bargaining rights and violates the
Charter of Rights and Freedoms. On October 11,

unions launched court challenges against the Ontario government citing
Bill 115 as unconstitutional.

On October 16, Dalton McGuinty ducked his responsibilities
by resigning as Premier and even more angering, he prorogued parliament.
Despite this, we will continue to fight against this legislation and any
future legislation which interferes with collective bargaining rights
protected under the Charter. “The Ontario Liberals cannot be allowed to get
away with this flagrant disregard for democracy. We are taking a stand for
all education workers, for all working people in this province, for our
students, and all those who depend on public services,” said Smokey Thomas
on the day of the court challenges.
