Beware
the jokers!
Job posting language is supposed to give you an
advantage when you apply for a different position with the AGCO.
Read the offer carefully.
There are two jokers in Art. 13.
Under 13.04 it says when skill, ability, qualifications and
experience are relatively equal "in the opinion of the employer," seniority will
rule.
It does not say the employers opinion has to be
right. You cant win a grievance on this language, even if the employer is dead
wrong.
Then there is 13.07!
"If the vacancy is not filled on the foregoing
basis" the employer may fill a vacancy at its discretion.
The employer needs no reason to ignore the posting
provisions. It does not say "if no suitable candidate is found in the process."
All it means is the employer must run a posting process,
even though the decision may already have been made to hire somebody else. Its a
farce and a sham.
And it doesnt give you anything.
Dont buy it.
